1. Acceptance of Terms  

By using the MiaCat Discord Bot (“the Bot”, “we”, “us”, or “our”), you agree to these Terms of Service.

2. Use of the Bot  

- You agree to use the Bot in compliance with all applicable laws and regulations.

- You will not use the Bot for unlawful, harmful, or abusive purposes.

3. Message Processing and Data Handling  

- Messages you send to the Bot are processed by a third-party Large Language Model (LLM) service to generate responses.

- Your messages may be transmitted to and processed by these third-party providers (e.g., OpenAI through Azure, Google Gemini, Anthropic, etc.).

- By default, your messages and context may be stored to improve the Bot’s responses.

- You may opt out of having your messages stored for conversation history and context at any time by using the `%optout` command. When opted out, your messages will not be retained for future context, but may still be processed in real time to generate replies and may be logged for procedural or security requirements.

- You may opt back in at any time by using the `%optin` command.

4. Limitation of Liability  

- The Bot is provided “as is” without warranties of any kind.

- We are not liable for any damages arising from your use of the Bot.

5. Changes to Terms  

We may update these Terms of Service at any time. When the terms are updated, the Bot will directly notify users that its terms have been changed before its next response to any command. Continued use of the Bot constitutes acceptance of the new terms.

The team developing the MiaCat Discord Bot (“the Bot”, “we”, “us”, or “our”) is committed to protecting your privacy. This Privacy Policy explains how we collect, use, and safeguard your information when you interact with our bot.

2. Information We Collect  

When you use the MiaCat Discord Bot, we may collect the following information:

- **User ID, Display Name:** Used in the response logic to personalize the Bot's replies to each individual user.

- **User Messages:** Messages you send to the bot are stored in a database by user ID and processed to generate responses. Messages are also logged using standard Discord means.

- **User Context:** Messages are stored and compacted into context summaries to improve bot responses. This context cannot be retrieved by other users and is not callable or used in interactions except those with the respective Discord User ID.

    - You may opt out of having your messages stored in separate databases for conversation history and context at any time by using the `%optout` command. Once used, only your Discord user ID will be stored and remembered for the purposes of complying with the order. This does not affect or halt messages being logged separately for procedural or security requirements.

    - When you opt out, your messages will not be retained in the bot’s conversation history or used to build future context for responses. This may reduce the efficacy and usefulness of some bot behaviors.

    - You may opt back in at any time by using the `%optin` command.

- **Note:** The bot must still process your message and Discord ID temporarily in real time to generate a reply, but will not retain it for future use in conversation history or for Language Model context.

- **Usage Data:** We may collect anonymized data about how you interact with the bot (e.g., usage frequency, error logs).

3. How We Use Your Information  

- **Message Processing:** Messages directed to the bot are processed by a third-party Large Language Model (LLM) service to generate responses.

- **Service Improvement:** Usage data may be used to improve the bot’s performance and user experience.

4. Data Sharing and Disclosure  

- **Third-Party Processing:** User messages are transmitted to and processed by the LLM provider (e.g., OpenAI through Azure, Google Gemini, Anthropic, etc.).

- **No Sale of Data:** We do not sell your personal information to third parties.

We take reasonable measures to protect your information. However, no method of transmission over the Internet is 100% secure.
